I Jotham Holt, of the town of Barre, County of Orleans, State of New York, do make and publish this my last Will and Testament in manner following viz: First, I give and bequeath to my beloved Wife Lydia Holt, all my real estate that I now possess, during her natural life time with all of the avails of said premises with one cow, twelve sheep, two hogs and all the house hold furniture in my possession. After my wife’s decease then to be equally divided amongst my lawful heirs excepting the heirs of my daughter Betsey now deceased formerly the wife of William Prout. Also all my personal property not described above after my debts are paid to be equally divided amongst my lawful heirs excepting my daughter Betsey said Prout’s wife as above described and to said Betsey’s heirs I will and bequeath the sum of five dollars. I also hereby appoint James Holt my executor and Lydia my wife Executrix to this my last Will and Testament. As witness whereof I have hereunto set my hand and seal this ninth day of October One Thousand eight hundred and thirty eight. In presence of DeWitt C. Warner of the town of Barre in said County being first duly sworn in open court on his Corporal Oath doth solemnly declare and say that he is a subscribing witness to the last Will and Testament of Jotham Holt late of the town of Barre in the County of Orleans, aforesaid deceased, and this deponent further says that the said Jotham Holt the said Testator did in the presence of this deponent acknowledge that he signed his name at the end of this testament which is now shown and exhibited to this deponent and which purports to be the last Will and Testament of the said Jotham Holt and which bears date of the ninth day of October in the year of our Lord one thousand eight hundred and thirty eight . And this deponent further says that the said Jotham Holt, the said Testator did at the time of subscribing his name as aforesaid: at the end of the said Will declare the said instrument so subscribed and now exhibited to be his Last Will and Testament and this deponent did thereupon subscribe his name at the end of the said Will as an attesting witness thereto at the request of the said Testator and in his presence. And this deponent further saith that at the said time when the said Testator subscribed his name to the said Last Will as aforesaid and at the time of this deponent subscribing his name as an attesting witness thereto as aforesaid the said Jotham Holt was of sound mind and memory of full age to execute a Will and was not under any restraint to the knowledge, information or belief of this deponent and that Theodorus Johnson the other subscribing witness to the said Will did at the same time together with this deponent subscribe his name to the said Will as a witness thereto at the request of the said testator in his presence and in presence of each other and further this deponent saith not.
